DMCA & Copyright Policy

1. Overview
ProofBeer respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws, ProofBeer will respond to legitimate notices of alleged copyright infringement and will take appropriate action including removing or disabling access to the infringing content.
ProofBeer is a platform that enables businesses to collect customer feedback and display reviews and testimonials. Content on the platform is primarily user-generated — submitted by your customers through forms or imported from third-party review platforms. ProofBeer does not independently verify the originality of user-submitted content.
2. Reporting Copyright Infringement
If you believe that content available on or through ProofBeer infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent. Your notice must include all of the following:
- Your identification: Your full legal name, address, telephone number, and email address.
- Description of the copyrighted work: A description of the copyrighted work you claim has been infringed, including a URL or copy of the work if available.
- Location of the infringing content: The specific URL(s) or location(s) on ProofBeer where the allegedly infringing content appears, with enough detail for us to locate it.
- Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or applicable law.
- Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
- Signature: Your physical or electronic signature.
Note: Submitting a false or fraudulent DMCA notice may result in liability for damages under 17 U.S.C. § 512(f), including costs and attorneys' fees.
3. Our Response to Takedown Notices
Upon receiving a complete and valid DMCA takedown notice, ProofBeer will:
- Acknowledge receipt of the notice within 48 hours
- Promptly remove or disable access to the allegedly infringing content
- Notify the user who submitted the content that it has been removed
- Provide that user with a copy of the takedown notice (with your personal contact information redacted if requested)
4. Counter-Notice Procedure
If you are a ProofBeer user and you believe that content you submitted was removed in error or misidentification, you may submit a counter-notice. Your counter-notice must include:
- Your full name, address, telephone number, and email address
- Identification of the content that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located
- Your physical or electronic signature
Send counter-notices to hello@proofbeer.com with the subject line DMCA Counter-Notice. Upon receipt of a valid counter-notice, ProofBeer will restore the removed content within 10–14 business days unless the original complainant files a court action.
5. Repeat Infringers
ProofBeer maintains a policy of terminating, in appropriate circumstances and at its sole discretion, the accounts of users who are determined to be repeat infringers of copyrights or other intellectual property rights.
6. Content Responsibility
ProofBeer account holders are responsible for ensuring that the review and testimonial content they collect and display does not infringe any third-party intellectual property rights. This includes images, videos, and written content submitted by form respondents. By using ProofBeer, you agree to indemnify ProofBeer against any claims arising from your failure to comply with this responsibility. See our Acceptable Use Policy for full details.
